IT IS EXPRESSLY UNDERSTOOD BY AND BETWEEN THE PARTIES TO THIS AGREEMENT THAT: The rental terms and conditions set forth on this agreement shall constitute the full and complete contract between Salt Island Scooter Rental, LLC. Hereinafter called the LESSOR, and the undersigned renter, hereinafter called the LESSEE, and no other terms or warranties expressed or implied shall alter the strict meaning and understanding of this agreement.

CUSTOMER AGREES TO THE FOLLOWING RENTAL CONDITIONS:

LESSEE agrees that no alcoholic beverages of any kind or quantity, no mood-altering or narcotic substances whatsoever, whether or not prescribed by a physician; and no personal accoutrements of any kind which may serve to increase the risk of operating the vehicle may be used by LESSEE during the time that the LESSEE has the vehicle in his/her use, possession and control; and

LESSEE agrees to return the Vehicle in the same condition as when it was rented, or to pay the full cost of repairs to restore the Vehicle to its original condition. LESSEE also assumes liability for, and agrees to promptly pay, all fines, penalties, or forfeitures imposed on LESSEE or Vehicle for trafficking, and any other violation of the law while the Vehicle is held, used, and/or operated by the LESSEE; and

LESSEE agrees to wear a helmet at all times a loaner helmet will be provided by the LESSOR. In the event of a lost or damaged helmet due to negligence the LESSEE will incur a $50

LESSEE must be at least 18 years of age and LESSEE has inspected the vehicle prior to the execution of the rental agreement and by the execution of this agreement agrees that the vehicle is in good mechanical condition.

IMPROPER USE OF THE VEHICLE, AS DETERMINED SOLELY BY THE LESSOR OR ANY AGENT OF THE LESSOR SHALL RESULT IN IMMEDIATE CONFISCATION OF THE VEHICLE. There shall be no refund of any monies paid in the event of the LESSOR's confiscation of the Vehicle and there will be no refunds given for any reason whatsoever (Weather, Personal Injury, Etc.).

The LESSEE's acknowledgment to the left of each paragraph above indicate that the LESSEE has read, acknowledges and understands the paragraph. The LESSEE has provided the LESSOR a valid driver's license. I HAVE READ AND AGREE TO ALL TERMS AND CONDITIONS OF THIS RENTAL AGREEMENT AND UNDERSTAND THE LEGAL RIGHTS THAT I AM GIVING UP BY SIGNING THIS DOCUMENT.

PARTICIPANT AGREEMENT, RELEASE AND ASSUMPTION OF RISK

In consideration of the services of Salt Island Scooter Rental LLC, their agents, owners, officers, volunteers, employees, and all other persons or entities acting in any capacity on their behalf (hereinafter collectively referred to as "SISR"), I hereby agree to release, indemnify, and discharge SISR, on behalf of myself, my spouse, my children, my parents, my heirs, assigns, personal representative and estate as follows:

I acknowledge that my participation in Moped and Scooter Riding activities entails known and unanticipated risks that could result in physical or emotional injury, paralysis, death, or damage to myself, to property, or to third parties. I understand that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activity.

The risks include, among other things: slipping and falling; accidents involving vehicles, other mopeds or scooters; collision with fixed or movable objects; injuries or accidents involving contact other vehicles; falls from the moped; accidents can occur getting on or off; drivers can be jolted, jarred, bounced around; major injuries are a risk as are sprains, strains, scratches, bruises, abrasions, cuts, lacerations, broken bones, fractures, musculoskeletal injuries including head, neck, and back injuries; injuries to internal organs; loss of fingers or other appendages; further, drivers can be thrown off the moped which can result in any of the above events occurring; collisions, and flipping over; the machine itself may fail; the negligence of other participants, spectators, or persons who may be present; damage to equipment or personal injury; exposure to the elements of the outdoors and natural surroundings which could cause hypothermia, hyperthermia (heat related illnesses), heat exhaustion, sunburn, dehydration; condition of roads, terrain, or highways and accidents connected with their use; accidents or illness can occur in remote places without medical facilities and emergency treatment or other services rendered; transmissible pathogen or disease; improper lifting or carrying; my own physical condition, and the physical exertion associated with this activity.

I expressly agree and promise to accept and assume all of the risks existing in this activity. My participation in this activity is purely voluntary, and I elect to participate in spite of the risks. I agree to wear a properly fitted and secured DOT or SNELL certified helmet while participating in this activity.
I hereby voluntarily release, forever discharge, and agree to indemnify and hold harmless SISR from any and all claims, demands, or causes of action, which are in any way connected with my participation in this activity or my use of SISR’s equipment or facilities, including any such claims which allege negligent acts or omissions of SISR.
Should SISR or anyone acting on their behalf be required to incur attorney's fees and costs to enforce this agreement, I agree to indemnify and hold them harmless for all such fees and costs.
I certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating, or else I agree to bear the costs of such injury or damage myself. I further certify that I am willing to assume the risk of any medical or physical condition I may have.
In the event that I file a lawsuit against SISR, I agree to do so solely in the state of Massachusetts, and I further agree that the substantive law of that state shall apply in that action without regard to the conflict of law rules of that state. I agree that if any portion of this agreement is found to be void or unenforceable, the remaining document shall remain in full force and effect.

By signing this document, I acknowledge that if anyone is hurt or property is damaged during my participation in this activity, I may be found by a court of law to have waived my right to maintain a lawsuit against SISR on the basis of any claim from which I have released them herein. I also agree that this document is valid for subsequent visits and participation at SISR. I have had sufficient opportunity to read this entire document. I have read and understood it, and I agree to be bound by its terms.
